On January 15, 2016, Martinez & McGuire obtained a victory on behalf of two railroad workers injured in a train wreck; specifically, Martinez & McGuire obtained a motion for summary judgment finding that Union Pacific Railroad Company violated federal law, that UP’s violation of federal law was a legal cause of the train wreck, and that UP was prohibited from asserting the defense of contributory negligence against the injured railroad workers. Consequently, when the case goes to trial, the only issue remaining for the jury to decide is the amount of damages caused to the two railroad workers by the train wreck.
Martinez & McGuire recently resolved the case for a Union Pacific Railroad Company locomotive engineer involved in a December 30, 2013 34 MPH head-on collision in Keithville, Louisiana that was caused by a BNSF Railway Company employee improperly lining a switch for the siding as opposed to the main track.

Clint McGuire of Martinez & McGuire recently settled the case of a Union Pacific Railroad Company (UP) locomotive engineer who sustained an amputated finger while closing the door on a UP locomotive.
Clint E. McGuire represented railroad conductor, David Bush, in his FRSA Whistleblower case against Union Pacific Railroad Company (UP). UP terminated Bush’s employment after learning that Bush had reported railroad safety concerns to the Mayor of Corpus Christi. Bush recently settled his case against UP, and has returned to work at UP as a conductor.
Clint E. McGuire represented Alexandra Lord, a young woman who was walking across the street and was hit and run over by a tractor-trailer. Alexandra sustained catastrophic injuries as a result of the incident. The case recently settled prior to trial.

Clint McGuire and Mario Mario Martinez represented a Union Pacific Railroad Company relief track inspector whose company vehicle derailed while traveling over a bridge, crashing 35 feet to the ground. The case was settled after the first trial setting to the satisfaction of the injured railroad worker.
On November 23, 2015, Clint McGuire obtained a summary judgment for a Port Terminal Railroad Association (PTRA) locomotive engineer finding, as a matter of law, that the Federal Locomotive Inspection Act applied to PTRA’s conduct. As a result, PTRA will be strictly liable for all of our client’s damages caused by the violation of the Locomotive Inspection Act.
Martinez & McGuire filed suit against Railcrew Xpress, LLC for injuries sustained to a Union Pacific Railroad Company conductor when the van (limo) he was in was unexpectedly struck by a train.
