Two railroad workers injured in a train wreck, trial scheduled

On January 15, 2016, Martinez & McGuire obtained a victory on behalf of two railroad workers injured in a train wreck; specifically, Martinez & McGuire obtained a motion for summary judgment finding that Union Pacific Railroad Company violated federal law, that UP’s violation of federal law was a legal cause of the train wreck, and that UP was prohibited from asserting the defense of contributory negligence against the injured railroad workers. Consequently, when the case goes to trial, the only issue remaining for the jury to decide is the amount of damages caused to the two railroad workers by the train wreck.
